These Terms of Service (“Terms”) govern your use of this website and any purchase from Ice Business Investments LLC (“we,” “us,” or “our”), operating the store Puddle Ducks Threads and Toys at Puddle-Ducks.com.

By visiting the site, creating an account, or placing an order, you agree to these Terms, our Shipping Policy, Return and Refund Policy, Privacy Policy, and Legal Notice. If you do not agree, do not use the site.

1. Who may use this store
You must be at least 18 years old and able to enter a binding contract. This store sells children’s clothing, toys, and related goods to adult buyers. You may purchase items for a child, but the account and payment method must belong to an adult. We do not knowingly collect personal information from children under 13.

2. Products and descriptions
We try to show products accurately, including photos, colors, sizes, materials, and prices. Colors can look different on different screens. Kids’ sizing varies by brand and style. Use the size chart and fit notes on each product page. We may limit quantities, discontinue items, or refuse or cancel an order.

If a price or description is clearly wrong, we may cancel the order and refund what you paid. We are not required to honor an obvious pricing error.

3. Orders and acceptance
An order is an offer to buy. We accept it when we send an order confirmation and charge your payment method, or when we fulfill the order. We may decline or cancel an order for suspected fraud, payment failure, stock issues, shipping restrictions, or a pricing error.

You may request a cancellation before the order is fulfilled. Once a shipping label is created or the order is packed, it is handled under our Return and Refund Policy, not as a cancellation.

4. Payment
Prices are in U.S. dollars and do not include shipping unless the cart qualifies for free shipping under our Shipping Policy. Applicable taxes are calculated at checkout. Payment is processed by Shopify and its payment partners. We do not store full credit-card numbers on our own servers.

5. Shipping
Shipping rates, zones, transit estimates, and delivery rules are in our Shipping Policy. Title and risk of loss pass to you when the carrier accepts the package. We are not responsible for delays caused by the carrier, weather, peak season, or an address you entered incorrectly. If a package is returned to us as undeliverable, we may reship it after you pay new shipping, or refund the merchandise minus original shipping.

6. Returns, exchanges, and refunds
Returns and exchanges follow our Return and Refund Policy. In short:

• You have 30 days from delivery to request a return or exchange.
• Items must be unworn, unwashed, unused, with tags attached, and in original packaging.
• You pay return shipping unless we sent the wrong item, a damaged item, or a defective item.
• Original outbound shipping is not refunded unless the return is our fault. If the order shipped free, the standard shipping rate may be deducted from the refund.
• Underwear, socks, tights, swimwear, personalized items, and items marked Final Sale cannot be returned or exchanged except when damaged, defective, or sent in error.
• We inspect returns. Items that are worn, washed, stained, odorous, or missing tags may be refused and shipped back to you at your cost.

7. Accounts
If you create an account, you are responsible for keeping the login information confidential and for activity under that account. Tell us promptly if you think the account was used without permission. We may close an account that is used for fraud, abuse, or repeated policy violations.

8. Acceptable use
You may not:

• Use the site for any unlawful purpose
• Attempt to hack, scrape, overload, or interfere with the site
• Submit false orders, false addresses, or stolen payment information
• Copy product photos, descriptions, or branding for commercial use without our written permission
• Post reviews or comments that are unlawful, defamatory, or that you do not have the right to post

We may refuse service or cancel orders if we reasonably believe these rules were broken.

9. Reviews and other content you submit
If you post a review, photo, or other content, you grant us a non-exclusive, royalty-free license to use, display, and reproduce that content in connection with the store. You represent that the content is accurate and that you own it or have permission to post it. We may remove content at our discretion.

10. Intellectual property
The store name, logos, product images, graphics, and written content are owned by us or used with permission. Using the site does not give you any ownership of that material.

11. Third-party services
The store runs on Shopify and may use carriers, payment processors, email tools, and other apps. Those providers have their own terms. We are not responsible for outages or acts of those third parties.

12. Disclaimer of warranties
The site and products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free. This does not limit any warranty that cannot be disclaimed under California or other applicable law, including any express product warranty stated on a product page.

13. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, even if we were told such damages were possible.

Our total liability for any claim related to the site or an order is limited to the amount you paid for that order.

Some states do not allow certain limitations. If those laws apply to you, some of the above may not apply, and you may have additional rights.

14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and reasonable legal fees arising out of your misuse of the site, your breach of these Terms, or content you submit, except to the extent caused by our own willful misconduct.

15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Except where applicable law requires otherwise, any court action must be filed in the state or federal courts located in Riverside County, California.

Before filing a claim, email us at puddleduckstemecula@gmail.com so we can try to resolve the issue. Nothing in these Terms limits any non-waivable consumer right you have under California law.

16. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the site after an update means you accept the revised Terms. For material changes, we may also post a notice in the store or send an email if we have one on file.

17. General
If a court finds any part of these Terms unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies linked above, are the entire agreement between you and us regarding the store. You may not assign your rights under these Terms without our consent.
